TERMS OF SERVICE

OVERVIEW

This website is run by Nonna Jewellery. Throughout the site, the terms
"I", "me" and "my" refer to Nonna Jewellery. I offer everything on this
site, including all information, tools, products and services, on the
condition that you accept the terms set out below, together with the other
policies and notices published on this website.

By using this website or buying from me, you agree to these terms.

If you do not agree to them, please do not use this website or my
services.

I may update or change these terms from time to time. Any changes will be
posted on this page. If you carry on using the website after a change, you
are taken to have accepted the updated terms, so far as the law allows.

My online shop is hosted on [PLATFORM NAME].

YOUR RIGHTS AS A CONSUMER

Nothing in these terms removes, limits or changes any right or remedy you
have under UK consumer law that cannot legally be excluded, limited or
changed.

That includes your rights under the Consumer Rights Act 2015 and the
Consumer Contracts (Information, Cancellation and Additional Charges)
Regulations 2013.

1. USING THE SHOP

By using this website you confirm that you are at least 18 years old, or
that you have a parent or guardian's permission.

You may not use my products or services for any unlawful or improper
purpose.

You may not send viruses, malicious code or any other harmful program
intended to interfere with the running or security of the website.

If you break these terms, I may suspend or end your access.

2. GENERAL CONDITIONS

I may refuse or limit service where it is reasonably necessary and the law
allows, for example where I suspect fraud, misuse or a breach of the law.

Payment details are sent using a secure payment service and appropriate
encryption.

Other information may be sent across networks where this is reasonably
necessary to run the service.

You may not reproduce, copy, sell, resell or exploit any part of the
service without my prior written permission, except where the law allows.

Headings are for convenience only and do not affect how these terms are
read.

3. ACCURACY OF INFORMATION

I make reasonable efforts to keep the information on this website accurate
and up to date.

Even so, typing errors, inaccuracies and omissions can happen.

Nothing in this section limits any duty I have under the law regarding
product descriptions or misleading information.

I may correct or update the content of the website where it is reasonably
necessary.

4. CHANGES TO SERVICES AND PRICES

Prices and availability may change without notice.

Price changes normally apply to future orders only. They do not affect
orders already confirmed, except where the law allows or where there has
been an obvious error.

I may change, pause or stop offering a product or service where it is
reasonably necessary.

Nothing in this section affects your rights under UK consumer law.

5. THE PIECES

Some pieces are sold online only and in limited numbers. In my current
clearance, I am offering 376 pieces finished by hand at my bench. Once
they are gone, they are gone.

I try to show the colour, finish, size and other details of each piece as
accurately as I can. Colours may look different depending on your screen
or device.

I reserve the right to:

limit the quantity available to any one person
  restrict sales where reasonably necessary
  stop selling a piece
  update descriptions and specifications

I will only use these rights within the limits of UK consumer law.

Buying something in a sale does not affect your statutory rights. A piece
being free or reduced does not remove any protection you have by law.

Please see my Returns and Refunds policy for more.

6. PAYMENT AND ORDER INFORMATION

I may refuse, cancel or limit an order where it is reasonably necessary,
for example where:

  I suspect fraud
the payment details appear to be wrong
the order appears to be for unauthorised resale
the order appears designed to get around purchase limits
the buying activity is unusual or suspicious

If I cancel an order after you have paid, I will refund you in line with
the law.

You agree to give accurate and current billing, delivery and account
details, and to keep them up to date.

7. THIRD PARTY TOOLS

I may give you access to tools, applications or services run by other
companies.

I do not control those services and, so far as the law allows, I am not
responsible for how they operate.

Using them may be subject to that company's own terms and privacy policy.

8. LINKS TO OTHER SITES

This website may contain links to sites run by other companies.

I am not responsible for the content, accuracy, policies, products or
services of sites I do not control.

Please read the relevant terms and policies before completing anything
with a third party.

Nothing in this section excludes any liability that cannot be excluded by
law.

9. REVIEWS AND ANYTHING YOU SEND ME

If you send me a review, photograph, comment, suggestion or other content,
I get a non-exclusive right to use it for reasonable business and
marketing purposes, in line with the law and my Privacy Policy.

You may not send content that:

  is unlawful or fraudulent
  infringes anyone's intellectual property
  contains malicious software
  is defamatory, abusive or threatening
is intended to mislead other customers

You are responsible for anything you send me.

10. YOUR PERSONAL INFORMATION

Any personal information you give me through this website is handled in
line with my Privacy Policy.

11. ERRORS AND OMISSIONS

This website may occasionally contain errors, inaccuracies or omissions
relating to:

  product descriptions
  prices
  promotions
  offers
  postage charges
  delivery times
  availability

So far as the law allows, I reserve the right to correct genuine errors
and update information.

Where an error significantly affects an order that has already been
confirmed, for example an obvious pricing mistake, I will contact you and
may cancel the order with a full refund.

Nothing in this section releases me from my duties under UK consumer law.

12. THINGS YOU MAY NOT DO

You may not use this website or its content:

for any unlawful or fraudulent purpose
  to infringe anyone else's rights
  to infringe intellectual property
to upload or spread malicious software
  to collect personal data unlawfully
  to impersonate anyone
to interfere with the security or running of the website
to attempt unauthorised access to my systems
in any way that could damage this website, my business or my customers

If you break these terms, I may suspend or end your access.

13. CONSUMER GUARANTEES AND LIMITS ON LIABILITY

Nothing in these terms removes, limits or changes any guarantee,
condition, right or remedy that cannot legally be excluded, limited or
changed.

Rights you have automatically by law are not removed simply by my terms, a
guarantee period, or a "no refunds" notice.

Nothing in these terms limits my liability for death or personal injury
caused by negligence, for fraud, or for anything else that cannot be
limited by law.

Subject to that, and so far as the law allows, I am not liable for loss
caused by:

something that was not reasonably foreseeable
  misuse of a piece
failure to follow the care instructions supplied
anything else where the law permits liability to be excluded

Nothing in this section limits your right to a remedy under UK consumer
law.

14. INDEMNITY

So far as the law allows, you agree to indemnify Nonna Jewellery against
reasonable losses, liabilities or costs arising directly from:

  unlawful use of the service
  deliberate misuse of the website
a serious breach of these terms
  infringement of someone else's rights

This only applies to the extent the loss was caused by what you did.

Nothing in this section limits rights or protections that cannot be
excluded by law.

15. IF PART OF THESE TERMS DOES NOT APPLY

If any part of these terms is found to be unlawful, invalid or
unenforceable, that part will be read down or limited to the smallest
extent necessary.

The rest of the terms will continue in full force.

16. ENDING THIS AGREEMENT

You may stop using the service at any time.

I may suspend or end your access where it is reasonably necessary,
including where you have seriously breached these terms.

Any rights, duties or liabilities that arose before the agreement ended
will continue to apply where necessary.

17. THE WHOLE AGREEMENT

These terms, together with the policies and notices published on this
website, make up the agreement between you and Nonna Jewellery about your
use of the service.

Nothing in them overrides consumer rights that cannot be excluded by law.

18. GOVERNING LAW

These terms are governed by the law of England and Wales, and any dispute
will be dealt with by the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring
proceedings in your local courts. Nothing here affects the consumer
protection you have where you live.

19. COMPLAINTS AND DISPUTES

If something has gone wrong with your order, a piece, or my service,
please write to me first:

hello@nonnajewellery.co.uk

I will look into it properly and try to put it right.

If we cannot resolve it between us, you can get free advice from Citizens
Advice on 0808 223 1133 or at citizensadvice.org.uk, who can refer the
matter to Trading Standards.

20. CHANGES TO THESE TERMS

The current version of these terms is always on this page.

I may update them to reflect changes to my service, how I work, or the
law.

Unless I say otherwise, changes apply from the day the updated terms are
posted.

No change removes a legal right that has already arisen on a purchase you
have already made.
